Common use of Timely Processing by City Clause in Contracts

Timely Processing by City. Upon submission by Developer of all appropriate applications and processing fees for any Subsequent Approval, City shall promptly and diligently commence and complete all steps necessary to act on the Subsequent Approval applications including, without limitation, (i) providing at Developer’s expense and subject to Developer’s request and prior written approval, reasonable overtime staff assistance and/or staff consultants for planning and processing of each Subsequent Approval application; (ii) if legally required, providing notice and holding public hearings; and

Upon submission by Developer of all appropriate applications and payment of the then current City-wide processing fees for any Subsequent Approval, City shall promptly and diligently commence and complete all steps necessary to act on the Subsequent Approval applications application including, without limitation, (i) providing at Developer’s expense and subject to Developer’s request and prior written approval, reasonable overtime staff assistance and/or staff consultants for planning and processing of each Subsequent Approval application; (ii) if legally required, providing notice and holding public hearings; and

Timely Processing by City. Upon submission by Developer of all appropriate applications and processing fees Processing Fees for any pending Subsequent Approval, City shall shall, to the full extent allowed by Applicable Law, promptly and diligently diligently, subject to City ordinances, policies and procedures regarding hiring and contracting, commence and complete all steps necessary to act on the Developer’s currently pending Subsequent Approval applications including, without limitation, : (i) providing at Developer’s expense and subject to Developer’s request and prior written approval, reasonable overtime staff assistance and/or staff consultants for planning and processing of each Subsequent Approval application; (iia) if legally required, providing notice and holding public hearings; andand (b) acting on any such pending Subsequent Approval application.
