Timing of Cy Pres Distribution. Any proceeds from the Net Settlement Fund that will be distributed to the Cy Pres Recipients shall be distributed by the Settlement Administrator to the Cy Pres Recipients between thirty (30) and forty-five (45) calendar days after the deadline for Class Members to cash the settlement checks pursuant to Section 2.3(d). Alternatively, in the event that the entire Net Settlement Fund is to be distributed to the Cy Pres Recipients under the terms of this agreement or as ordered by the Court, the Settlement Administrator shall distribute such proceeds to the Cy Pres Recipients between thirty (30) and forty-five (45) calendar days after the Final Settlement Date.
