Net Settlement Fund definition

Net Settlement Fund means the Settlement Fund less: (i) any Taxes;

Net Settlement Fund means the Settlement Fund, plus accrued interest, less any award of attorneys’ fees or reimbursement of expenses and less applicable taxes, tax preparation expenses, and costs of notice and administration, that may be awarded or approved by the Court.

• To the extent the Court approves incentive awards in amounts less than the not to exceed amounts stated above, the difference, and any interest attributable to the amount of the difference while in the Settlement Fund Account, shall be included in and treated as a part of the Net Settlement Fund.

• To the extent the Court awards expenses and costs in an amount that is less than the not to exceed amount stated above, the difference and any interest attributable to the amount of the difference while in the Settlement Fund Account, shall be included in and treated as a part of the Net Settlement Fund.

• The amount of any such fee award approved by the Court, and any interest attributable to said amount while in the Settlement Fund Account, shall be deducted from the Net Settlement Fund to determine the Net Distributable Settlement Fund and the individual Trust Loans Settlement Class Member Payments.

More Definitions of Net Settlement Fund

Net Settlement Fund means the amount of funds that remain in the Settlement Fund after funds are paid from or allocated for payment from the Settlement Fund for the following: (i) Notice and Administrative Expenses, (ii) Taxes and Tax-Related Expenses, (iii) Service Awards Payments approved by the Court, (iv) Fee Award and Costs approved by the Court.

Net Settlement Fund means the net amount of the Settlement Fund after payment of court approved attorneys’ fees and costs, any court approved service award and the costs of Notice, and any fees paid to the Claims Administrator.
