Title and Operation. Any right, title and interest to the properties described on Schedules 2(a) and 2(b) and the corresponding leases, operating rights, xxxxx and appurtenant facilities held by Wexpro will be and remain the sole and exclusive property of Wexpro and will be held and operated by Wexpro in accordance with the terms and conditions of this Article II. Oil, natural gas, and natural gas liquids from productive oil reservoirs will be developed and produced by Wexpro in a prudent manner in accordance with accepted industry standards.
Title and Operation. 1.1 This Agreement shall be known as the GenesisCare Oncology NSW Patient Services and Radiation Therapists Enterprise Agreement 2022 (Agreement). 1.2 This Agreement shall start to operate on the first full pay period commencing seven (7) days after its approval by the Fair Work Commission and shall remain in force until 30 June 2025 and thereafter in accordance with the Fair Work Xxx 0000 (Cth) (FW Act). 1.3 This Agreement: (a) represents the consolidation of wages and conditions of employment for the Employees covered by this Agreement; (b) subject to subclause 3.2, constitutes the entire agreement between GenesisCare and the Employees as to its subject matter and, subject to subclause 27.2, supersedes all prior representations and agreements in connection with that subject matter; and (c) may only be altered or varied by agreement in accordance with the provisions of the Fair FW Act. 1.4 The National Employment Standards (NES) shall prevail over this Agreement to the extent that the NES provides a more favourable outcome for an Employee.
Title and Operation. 1.1 This Agreement shall be known as the La Trobe University Collective Agreement 2018. 1.2 The Agreement will commence operation seven (7) days after its approval by the Fair Work Commission, and the nominal expiry date will be 30 September 2021. 1.3 No later than three (3) months prior to the nominal expiry of this Agreement, the University and the NTEU will hold discussions about when negotiations for a new Agreement will commence.

  • Title and Risk 6.1 The risk in the Products shall pass to the Customer on completion of delivery to the Delivery Location. 6.2 Legal and beneficial title to the Products shall not pass to the Customer until the earlier of:‌ (a) Ornua receives payment in full (in cash or cleared funds) for the Products, in which case title to the Products shall pass at the time of payment of all such sums; and (b) the Customer resells the Products, in which case title to the Products shall pass to the Customer at the time specified in clause 6.4. 6.3 Until title to the Products has passed to the Customer, the Customer shall:‌ (a) hold the Products as Ornua’s fiduciary agent and bailee; (b) not pledge or in any way charge by way of security the Products; (c) store the Products separately from all other products held by the Customer so that they remain readily identifiable as Ornua's property; (d) not remove, deface or obscure any identifying mark or packaging on or relating to the Products;‌ (e) maintain the Products in satisfactory condition and keep them insured against all risks for their full price on Ornua's behalf from the date of delivery; (f) notify Ornua immediately if it becomes subject to any of the events listed in clause 17.2(b) or clause 17.2(c); and (g) give Ornua such information relating to the Products as Ornua may require from time to time.‌‌ 6.4 Subject to clause 6.5, the Customer may resell or use the Products in the ordinary course of its business (but not otherwise) before Ornua receives payment for the Products. However, if the Customer resells the Products before that time: (a) it does so as principal and not as Ornua’s agent; and (b) title to the Products shall pass from Ornua to the Customer immediately before the time at which resale by the Customer occurs. 6.5 If before title to the Products passes to the Customer the Customer becomes subject to any of the events listed in clause 17.2(b) or clause 17.2(c), then, without limiting any other right or remedy Ornua may have:‌ (a) the Customer's right to resell Products or use them in the ordinary course of its business ceases immediately; and‌ (b) Ornua may at any time: (i) require the Customer to deliver up all Products in its possession which have not been resold, or irreversibly incorporated into another product; and (ii) if the Customer fails to do so promptly, enter any premises of the Customer or of any third party where the Products are stored in order to recover them.

  • Title and Risk of Loss Notwithstanding the form of shipment, title or other property interest, risk of loss shall not pass from the Contractor to the Authorized User until the Products have been received, inspected and accepted by the receiving entity. Acceptance shall occur within a reasonable time or in accordance with such other defined acceptance period as may be specified in the Bid Specifications or Purchase Order. Mere acknowledgment by Authorized User personnel of the delivery or receipt of goods (e.g., signed xxxx of lading) shall not be deemed or construed as acceptance of the Products received. Any delivery of Product that is substandard or does not comply with the Bid Specifications or Contract terms and conditions, may be rejected or accepted on an adjusted price basis, as determined by the Commissioner.
