WAGES AND CONDITIONS OF EMPLOYMENT. (a) The wages and conditions of employment of the Subcontractor’s employees engaged on the Works must be no less than the minimum prescribed by the competent authority in the trade to which such employees belong.
(b) If the Subcontractor fails to comply with his obligations as to payments under paragraph (a) above or if he fails to make any other payments (whether by stamping cards or by payments by levy or otherwise) in respect of his employees engaged on the Works Xxxxxx
WAGES AND CONDITIONS OF EMPLOYMENT. A. Subject to the provisions of this Agreement, the hourly rates of pay, overtime, working conditions, travel or subsistence allowances, and all fringe benefits shall be those established through collective bargaining between the appropriate Local Union and/or District Council and the local contractors in the area where the particular job of the Employer is located.
B. In order to maintain continuity of work on the Employer’s projects and to insure against any work stoppage in the event of a breakdown of local negotiations, it is agreed that when a local agreement terminates, the Employer will continue to observe the terms and conditions contained therein until a new contract has been reached between the Local Union and/or District Council and the contractors in the area. Pending local settlement, there shall be no work stoppage on the Employer’s job; provided, however, that when negotiations are completed, the Employer agrees to comply with the terms of the new agreement, whichever is the earlier date.
C. When the Employer enters an area where wages and conditions of employment have not been established pursuant to negotiations between the appropriate Local Union and/or District Council and the contractors in the area, the Employer and the Union will negotiate such wages and other conditions of employment as are necessary and reduce their understanding to writing. It is understood and agreed that, should the parties fail to agree, either party shall be permitted full economic recourse to support its position, and the provisions of Article XV shall not be applicable.
D. The Employer agrees to become party to the standard fringe benefit trust agreements which have been entered into between local contractors and the Local Union and/or District Council involved.
E. The Employer agrees to make timely payments into all fringe benefit funds negotiated and established under the applicable Local Union and/or District Council collective bargaining agreement.
F. Notwithstanding the terms of any local union negotiated agreement, an Employer signatory to this Agreement shall make the fringe benefit contributions for the Employer’s “key men” to the trust funds designated by the “key men” as their home trust funds, and shall not be obligated to contribute for the “key men” to any other trust funds, provided that the trust funds so designated agree to accept the contributions and credit the “key men” for those contributions in accordance with the trust funds’ rules. WAGES AND CONDITIONS OF EMPLOYMENT. 2.5.1 The Base Rate of pay for each employee shall be not less than as provided for in the relevant Australian Pay and Classification Scale (“Base Rate”), or if there is none then the relevant Federal Minimum Wage set by the Australian Fair Pay Commission.
2.5.2 In addition to the Base Rate, and in lieu of the wage rates set out in the relevant Australian Pay and Classification Scale, wages shall be determined according to the provisions of this Agreement.
2.5.3 Wages will be reviewed annually on the anniversary of the lodgment of this Agreement. Such review shall take into account, amongst other things, the conduct and performance of each employee; the economic conditions, profitability and known future contracts of the Enterprise.
2.5.4 Depending on the outcome of the review, wages for each employee may be increased or remain the same.
WAGES AND CONDITIONS OF EMPLOYMENT. 8.1 Employees who are bound by this agreement shall be paid the rates and allowances as prescribed in Appendix A. These wage rates and conditions are effective from the date specified in Appendix A. The company has also agreed to contribute to a maximum of 1.3% of their base wage towards income protection insurance with any further costs above 1.3% borne by the employee. 8.2 The wage increase specified in this clause shall be payable in addition to the current agreed enterprise rates of pay and shall be paid for all purposes of the award.
8.3 BHP allowance to be paid in accordance with clause 15.2.1.1 of the parent award. This clause relates to BHP Flat Products, BHP Sheet and Coil and CRM for industrial site work only. It does not relate to work completed in commercial plants such as offices, cafeterias, conference rooms, laboratories etc. The current rates are all encompassing and no other industry allowances will be paid.
8.4 It is a term and condition of employment and of the obligations and rights occurring under this Agreement, that an employee:
i. properly use and maintain all appropriate protective clothing, tools and equipment supplied by the Company for specified circumstances; and
ii. use technology and perform duties which are within the limits of the employee’s skill, competence and training as per clause 9.1 of the award; and
iii. understand that termination of employment will be based on job requirements and skills and that the principle of ‘last on-first off’ will not apply. It is the needs and requirements of the Company, together with the efforts, skills and abilities of the employee which will be the determining factors regarding retrenchment of employees; and
iv. maintain commitment to, and comply with the Company’s directions (consistent with the objectives of the Agreement) with respect to, safety, quality, site cleanliness and waste management; and
v. provide and maintain an adequate kit of tools in accordance with Appendix B requirements; and
vi. be committed to the objectives in Clause 7 of this Agreement
8.5 All new employees (other than casuals) will be engaged on the basis of a 3-month probationary period, which shall count as service. The Company reserves the right to terminate a probationary employee at any time during this 3-month period subject to a week’s notice or payment in lieu thereof.

WAGES AND CONDITIONS OF EMPLOYMENT. 3.1 Wages increases and salary rates In accordance with the salary schedule at 3.3, a salary rate increase of 0.3% will apply to all pay points backdated to 20 February 2016, to meet the Queensland wages policy of 2.5%. Further a 2.5% increase will apply from 1 October 2016 and 1 October 2017. Except that for employees whose salary exceeds the top pay point for their grade (as varied during the term of this agreement), there will be no increase to their total salary until the top pay point for their grade exceeds their total salary.
3.2 Annual performance reviews and links to salary
3.2.1 Performance Ratings Employees who achieve a rating of effective or superior for their Annual Performance Review (as per the relevant WCEO performance review process) will be entitled to progress by the following number of pay points subject to clause 3.3: Effective 2 pay points Superior 3 pay points
3.2.2 Application of Performance based Salary Increases
(a) Employees who commenced employment or were promoted between 1 April and 31 July (inclusive) in a year shall be entitled to a pay point progression of one pay point for that year.
(b) Employees who commence or are promoted after 31 July in a year are not entitled to any pay point progression until 1 October in the following year.
(c) Employees who have reached the highest pay point for their grade will be eligible to receive an OOP if they achieve a superior performance rating. The amount of the OOP will be equivalent to half a pay point increment for the employee’s grade.
(d) Employees on salary maintenance arrangements are not eligible for an OOP; as they are subject to other arrangements.
(e) Salary increases due to pay point progression and lump sum OOPs will be paid from 1 October, in recognition of performance during the preceding financial year, that is:

WAGES AND CONDITIONS OF EMPLOYMENT. 11.1 The hourly rates of pay are contained in the table as set out in Part B. Those rates of pay include the $2.00 productivity payment and the first increase referred to in Clause 11.2 below.
WAGES AND CONDITIONS OF EMPLOYMENT. 2.18.1 The Base Rate of pay for plumbers shall be not less than as provided for in the Australian Pay and Classification Scale derived from the Plumbing Trades (Southern States) Construction Award 1999 (the “APCS”).
2.18.2 In addition to the Base Rate and in lieu of the wage rates set out in the APCS wages shall be determined according to the provisions of Schedule 1 this agreement.
2.18.3 Conditions of employment shall be as set down in the Plumbing Trades (Southern States) Construction Award 1999 except where otherwise provided for in this Agreement.
