Title to Product. If access to the Product requires an application program interface (API), Contractor shall convey to Purchasing Entity an irrevocable and perpetual license to use the API.
Title to Product. Title to all of the Customer’s Product received, stored and handled by the Operator at these Terminals shall remain at all times in the name of the Customer. The Customer agrees not to deliver for storage at these Terminals any Product which may not be lawfully stored on the premises of these Terminals or any Product injurious to the premises or facilities, or which would render the facilities unfit, after cleaning, for the proper storage of similar product, or Products.

However, if CUSTOMER is in breach hereof or fails to remove all Product from Facility at termination of this Agreement at WESTWAY’s direction to do so, to the extent permitted by the applicable law governing this Agreement, WESTWAY may sell the remaining product and apply all proceeds therefrom against any amounts due and owing to it by CUSTOMER (including the costs of such sale), and the balance of such proceeds, if any, shall be remitted to CUSTOMER.
Title to Product. Title to and ownership of the Products shall remain solely with the Client at all times, and the Client shall be solely responsible for the care, custody or control of all Product except when it is physically in RXTPL's possession.

It is understood and agreed that (i) title to the Product received hereunder shall remain in CUSTOMER, subject to being commingled with like Product belonging to SOUTH TEXAS and/or other parties, which CUSTOMER hereby grants unto SOUTH TEXAS the right to do so, and ii) Product redelivered to CUSTOMER by SOUTH TEXAS may not be identical Product delivered by CUSTOMER.
Title to Product. Title to the Product is reserved to the Licensor. The Licensor is and shall remain the sole and exclusive owner of the Product, to the exclusion of all others. Licensee shall take no acts inconsistent with the foregoing.
