Common use of TITLE VI NONDISCRIMINATION Clause in Contracts

TITLE VI NONDISCRIMINATION. 16.32.1. Concessionaire shall comply with applicable non-discrimination provisions required by the United States of America, including but not limited to the provisions of 49 CFR Part 21. These provisions are inclusive of any amendments which may be made to such regulations. Further, Concessionaire shall include the summary of the provisions of 49 CFR Part 21, as may be amended, in subcontracts it enters into under this Agreement. This summary is set forth in Exhibit “ ”, attached and incorporated herein. 16.32.2. Concessionaire, for itself, its personal representatives, successors in interest, Subcontractors, and assigns, as a part of the consideration hereof, does hereby covenant and agree that, (i) no person on the grounds of race, color, or national origin shall be excluded from participation in, denied the benefits of, or be otherwise subjected to discrimination in the use of said Facilities, (ii) that in the construction of any improvements and the furnishing of Concession services in the Facilities, no person on the ground of race, color, or national origin shall be excluded from participation in, denied the benefits of, or otherwise be subjected to discrimination, (iii) that Concessionaire shall use the Facilities in compliance with all other requirements imposed by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-Assisted Programs of the Department of Transportation-Effectuation of Title of the Civil Rights Act of 1964, and as said Regulations may be amended. That in the event of breach of any of the above non-discrimination covenants, City shall have the right to terminate this Agreement and hold the same as if this Agreement had never been made or issued.
