Common use of TOWERS AND SHELTERS Clause in Contracts

TOWERS AND SHELTERS. Except as provided in Section 2 of Schedule A, this Maintenance Agreement does not include maintenance obligations for any tower, tower lighting, FCC or FAA tower regulatory requirement or equipment shelter which shall be owned and maintained by Incumbent outside of the scope of this Maintenance Agreement; provided, however, that Incumbent shall maintain such towers and shelters as reasonably required to support the continuous and reliable operation of the System and network without material degradation to either the Equipment or System.

Except as provided in Section 2 of Schedule A, this Maintenance Agreement does not include maintenance obligations for any portion of the Facilities, including any tower, tower lighting, FCC or FAA tower regulatory requirement or equipment shelter shelter, each of which Incumbent shall be owned and maintained by Incumbent maintain outside of the scope of this Maintenance Agreement; provided, however, that Incumbent shall maintain such towers and shelters the Services as reasonably required to support the continuous and reliable operation of the System and network without material degradation to either the Facilities, the Equipment or the System.
