Common use of TOXIC SUBSTANCES Clause in Contracts

TOXIC SUBSTANCES. (a) Employees using toxic substances or materials of a like nature will be paid 76 cents per hour extra. Employees working in close proximity to employees so engaged will be paid 63 cents per hour extra. (b) For the purpose of this sub clause toxic substances will include epoxy-based materials and all materials which include or require the addition of a catalyst hardener and reactive additives or two-pack catalyst system will be deemed to be materials of like nature.

Employees working in close proximity to employees so engaged will shall be paid 63 cents $0.49 per hour or part thereof extra.
