Common use of Traffic Subject to Reciprocal Compensation Clause in Contracts

Traffic Subject to Reciprocal Compensation. Reciprocal Compensation is applicable for Transport and Termination of Local Traffic as defined in Section 1.12 and is related to the exchange of traffic described in Section 4. For the purposes of billing compensation for Local Traffic, billed minutes will be based upon records/reports provided by Qwest or Alltel or actual recorded usage, where available. Measured usage begins when the terminating recording switch receives answer supervision from the called end-user and ends when the terminating recording switch receives or sends disconnect (release message) supervision, whichever occurs first. The measured usage is aggregated at the end of the measurement cycle and rounded to a whole minute. Billing for Local Traffic shall be based on the aggregated measured terminating usage to the RLEC less traffic recorded as local that is Non-Local Traffic. Notwithstanding any provision to the contrary set forth herein, the Parties agree that Reciprocal Compensation for Transport and Termination of Local Traffic shall be determined on the basis of eighty percent (80%) of the total traffic terminates on the RLEC network and twenty percent (20%) of the total traffic terminates on Western Wireless’ network. Such percentages shall apply to both Type 2 Direct and Indirect Service as defined herein.
