Common use of Traffic Subject to Reciprocal Compensation Clause in Contracts

Traffic Subject to Reciprocal Compensation. Reciprocal Compensation is applicable for Transport and termination of Telecommunications Traffic as defined in Section 1.26, whether exchanged directly or indirectly as provided in Attachment I, Section 1.0 above. For the purposes of billing compensation for Telecommunications Traffic, billed minutes will be based upon actual usage recorded or records/reports provided by the transiting carrier may be the basis for billing, or until such time as CINGULAR has the capability to record and measure, the Parties shall use the traffic factor methodology in Attachment 1, Section 2.3.2. Measured usage begins when the terminating recording switch receives answer supervision from the called end-user and ends when the terminating recording switch receives or sends disconnect (release message) supervision, whichever occurs first. The measured usage is aggregated and rounded to a whole minute. Billing for Telecommunications Traffic shall be based on the aggregated measured usage plus usage from reports provided by the transiting carrier less traffic that is interMTA and subject to Switched Access Compensation. The rate for Reciprocal Compensation for XXXXX shall be: Local Switching $0.019705 per conversation minute Tandem Switched Facility $.000161 per conversation minute per mile Tandem Switched Termination $0.001472 per conversation minute The rate for Reciprocal Compensation for CINGULAR shall be: $0.019705 per conversation minute. The above rates for traffic subject to Reciprocal Compensation shall be used until the Commission has approved a new forward looking Total Service Long Run Incremental Cost ("TSLRIC") study. The Agreement will be amended as of the date of the Commission Order approving the new TSLRIC study, the amendment reflecting the rates resulting from the new TSLRIC study. The amended rates will apply on a going- forward basis only. The above paragraph and rates are incorporated into this Agreement as a result of a February 21, 2006 Order of the Michigan Public Service Commission in MPSC Case No. U-14678. By entering into this Agreement, neither party waives, but instead expressly reserves, all of its rights, remedies and arguments with respect to any challenge to, or appeal of, said Commission Order.
