Train Operator’s right to terminate. The Train Operator may serve a Termination Notice on Network Rail:
(a) where Network Rail fails to comply with its obligations under paragraph 2.5.3;
(b) where the Network Rail Event of Default specified in paragraph 1.3(a) has occurred and is continuing; or
(c) where the Network Rail Event of Default specified in a Suspension Notice served by the Train Operator is not capable of being remedied and 3 months have elapsed from the service of that Suspension Notice.
Train Operator’s right to terminate. The Train Operator may serve a Termination Notice on the CVL IM:
(a) where the CVL IM fails to comply with its obligations under paragraph 2.5.3;
(b) where the CVL IM Event of Default specified in paragraph 1.3(a) has occurred and is continuing; or
(c) where the CVL IM Event of Default specified in a Suspension Notice served by the Train Operator is not capable of being remedied and 3 months have elapsed from the service of that Suspension Notice.
Train Operator’s right to terminate. The Train Operator may serve a Termination Notice on RfL(I):
(a) where RfL(I) fails to comply with its obligations under paragraph 2.5.3;
(b) where the RfL(I) Event of Default specified in paragraph 1.3
(a) has occurred and is continuing; or
(c) where the RfL(I) Event of Default specified in a Suspension Notice served by the Train Operator is not capable of being remedied and three months have elapsed from the service of that Suspension Notice.
Train Operator’s right to terminate. The Train Operator may serve a Termination Notice on Nexus:
(a) where Nexus fails to comply with its obligations under paragraph 2.5.3;
(b) where the Nexus Event of Default specified in paragraph 1.3(a) has occurred and is continuing; or
(c) where the Nexus Event of Default specified in a Suspension Notice served by the Train Operator is not capable of being remedied and 3 months have elapsed from the service of that Suspension Notice.
Train Operator’s right to terminate. The Train Operator may serve a Termination Notice on DB Cargo:
(a) where, except during the period of a Suspension Notice relating to it, an DB Cargo Event of Default has occurred and is continuing;
(b) where DB Cargo fails to comply with its obligations under paragraph 2.5.3, provided that the relevant DB Cargo Event of Default is continuing; or
(c) where [ BShort ] is serving three months’ notice of its intention to terminate.
Train Operator’s right to terminate. Subject to paragraph 5, the Train Operator may serve a Termination Notice on HS1 Ltd with a copy of such Termination Notice to the XXX:
(a) where HS1 Ltd fails to comply with its obligations under paragraph 2.5(c); or
(b) where the HS1 Ltd Event of Default specified in a Suspension Notice served by the Train Operator is not capable of being remedied and three months have elapsed from the service of that Suspension Notice.
