TRANSFER AND OPERATION OF THE REGULATIONS. 3.1 The Parties intend and acknowledge that the closing of the School and the opening of the Academy shall constitute a transfer to which the Directive and the Regulations apply. The Parties agree that as a consequence the contracts of employment made between the current employer and the Transferring Employees shall have effect from and after the Transfer Date, as if they were originally made between the Company or (as the case may be) a Contractor and the Transferring Employees.
