Transfer of Site. Delta Fiber shall be entitled to transfer to a third party information it collects, including any Personally Identifiable Information, in connection with a sale of all or substantially all of the assets of the business entity responsible for the information under this Privacy Policy, provided the acquiring third party has agreed to safeguard your Personally Identifiable Information.
Transfer of Site. [Redeveloper] shall provide the Department with prior written notice of any transfer of ownership of the Site including the identity of the purchaser and the purchaser's Intended Purpose for the Site. Prior to transfer, [Redeveloper] shall give the purchaser a copy of this Consent Order and Agreement including a copy of Exhibits A and B. [Redeveloper] shall satisfy the applicable deed acknowledgement requirements of the Solid Waste Management Act and the Hazardous Sites Cleanup Act.
Transfer of Site a. The duties and obligations under this Consent Order and Agreement shall not be modified, diminished, terminated or otherwise altered by the transfer of any legal or equitable interest in the Facility or any part thereof.
b. If Shell intends to transfer any legal or equitable interest in the Facility which is affected by this Consent Order and Agreement, Shell shall serve a copy of this Consent Order and Agreement upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the Southwest Regional Office of the Department of such intent.
Transfer of Site a. The duties and obligations undet this Consent Order and Agreement shal l not be modified, diminished, terminated, or otherwise ,altered by the transfer of any legal or equitable interest in the Site or any part thereofunh�ss authorized by the Department in writing.
b. If H'orsehead intends to transfer any legal or equitable interest in the Site which is affected by this Consent Order and Agreement, Horsehead shall serve a copy of this Consent Order and Agreement upon the prospective transferee of the legal and equitable interest .at least thirty (30) days prior to the contemplated ! transfer and shall simuitaneous1y inform the Southwest Regional Office of the Department of such intent.
Transfer of Site. (a) The duties and obligations under this Consent Order and Agreement shall not be modified, diminished, terminated or otherwise altered by the transfer of any legal or equitable interest in the Authority, or any part thereof.
(b) If Authority intends to transfer any legal or equitable interest in Authority or the property which is affected by this Consent Order and Agreement, Authority shall serve a copy of this Consent Order and Agreement upon the prospective transferee of the legal and equitable interest at least 30 days prior to the contemplated transfer and shall simultaneously inform the named individual in Paragraph 9, below, of such intent.
(c) DEP in its sole discretion may agree to modify or terminate Authority’s duties and obligations under this Consent Order and Agreement upon transfer of Authority. Authority waives any right that it may have to challenge DEP’s decision in this regard.
Transfer of Site. As further set forth in Article VI below, within fifteen (15) days of expiration of the Due Diligence Period, the FRC shall transfer the Site to NPD pursuant to a limited warranty deed that includes as an exception the Right of Reconveyance consistent with Section 3.03.
Transfer of Site. As further set forth in Article VII, within fifteen (15) days of expiration of the Due Diligence Period, the FRC shall transfer the Office Site to BBS pursuant to a limited warranty deed that includes as an exception for the Right of Reconveyance consistent with Section 5.03.
Transfer of Site. As further set forth in Article VIII, Building Corp. shall convey the Office Site to Developer pursuant to the Office Site Deed.
