Common use of Transfer to Position Outside of the Bargaining Unit Clause in Contracts

Transfer to Position Outside of the Bargaining Unit. An employee who is transferred to a managerial position for a period of six (6) months shall retain, but not accumulate, seniority held at the time of the transfer. In the event the employee is returned to a position in the bargaining unit he/she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of his/her return to the bargaining unit. The Union and the Employer may agree to an extension up to twelve (12) months.

An employee who is transferred to a managerial position outside the bargaining unit for a period of six up to twelve (612) months months, or such longer period of time as may be agreed by the Local Union and the Hospital, shall retain, retain but not accumulate, accumulate seniority held at the time of the transfer. In the event the employee is returned to a position in the bargaining unit he/she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of his/her return to the bargaining unit. The Union and the Employer may agree to an extension up to twelve (12) months.
