Common use of Transshipment and Direct Shipment Clause in Contracts

Transshipment and Direct Shipment. A good shall not be considered as originating even if it has been produced in accordance with the requirements of Article 6-03, if subsequent to such production, the good undergoes further processing or is subject to any other operation outside the territories of the Parties, except unloading, reloading or any other movement necessary to maintain it in good condition or to transport it to the territory of a Party.

Transshipment and Direct Shipment. A good shall not be considered as originating originating, even if it has been produced in accordance with the requirements of Article 6-034.3, if subsequent to such production, the good if: (a) undergoes further processing processing, is the subject of a production process, or is subject to any other operation outside the territories of the Parties, except unloading, reloading or any other movement operation necessary to maintain it preserve the good in good condition or to transport it to the territory of the other Party; or (b) does not remain under the control or supervision of the customs authority in the territory of a Partynon-Party State.
