Treatment of Enhancement Facilities. Any payment made under an Enhancement Facility, to the Holders of the Subordinated Obligations having the benefit of such Enhancement Facility, by the appropriate obligor thereof shall be retained by such Holders for their own account, and no Holder of Senior Indebtedness is to have any right with respect to any such payment so made. As between the obligor whose Enhancement Facility secures any Subordinated Obligation and the Holder of such Subordinated Obligations, any payment made on such Subordinated Obligation by the Authority which, under the subordination provisions of this Article, is required to be paid over to the Holders of the Senior Indebtedness, shall not constitute a payment on such Subordinated Obligation but, instead, shall be treated for all purposes of such Enhancement Facility, as though such payment had not been made by the Authority. Until the Holder of the Subordinated Obligation so guaranteed has received from the Authority, or from such obligor, moneys which such Holder is entitled to retain for its own account, equal in the aggregate to the principal amount of his Subordinated Obligation and any accrued and unpaid interest thereon, such obligor shall remain liable on its Enhancement Facility, and, unless otherwise provided in such Enhancement Facility, shall not be subrogated to any of the rights of the Holder of such Subordinated Obligation.

In no event shall Licensee assume any liability for third party’s compliance with the terms of the Non-Disclosure Agreement, nor shall the Non-Disclosure Agreement create or impose any liabilities on the State or Licensee. Any third party with whom a Licensee has a relationship for a state function or business operation, shall have the temporary right to use Product (e.g., JAVA Applets), provided that such use shall be limited to the time period during which the third party is using the Product for the function or business activity.

  • Verizon OSS Facilities Any gateways, interfaces, databases, facilities, equipment, software, or systems, used by Verizon to provide Verizon OSS Services to CBB.

  • Use of University Facilities Members may use the office assigned to them in connection with such professionally-related activities as preparation of professional manuscripts and materials, scholarly endeavors, approved consultancies, and service to professional associations, schools, or other groups or agencies for whom such service is appropriate. Upon request, faculty may use laboratories and studios for non-sponsored research and other scholarly activity. Upon request, faculty may use meeting rooms and other physical facilities for professionally-related groups subject to availability and prevailing policies of the University governing use of facilities. The facilities of the TRC, Print Shop, computer labs and the use of University equipment are available to the faculty in connection with professional writing, research, or approved service projects subject to availability and to reimbursement at prevailing rates charged by the University.

  • Toilet Facilities The Employer provides the Contractor access to toilet facilities. Temporary chemical toilets are provided by the Contractor where deemed necessary.

  • Alternate Facilities If under Purchaser’s Operating Schedule, roads needed for the removal of Included Timber differ substantially from Specified Roads, other roads may be added to A7. Contracting Officer shall assure that road routing, location, design, and needed easements will make such other roads acceptable as parts of the National Forest transportation facilities. Purchaser shall provide survey, design, and construction staking for such other roads. Based on design quantities from such engineering, Forest Service shall estimate Specified Road construction costs of alternate facilities, using methods consistent with those used in the original computation of the Schedule of Items. If Specified Road construction costs for acceptable alternate facilities are less than the estimated costs of facilities listed in the original Schedule of Items that Purchaser does not construct, Timber Sale Account shall be adjusted by Forest Service to reflect the reduction in costs. In event of rate redetermination under B3.3, such allowed costs shall be the redetermined estimated costs of facilities listed in the original Schedule of Items that Purchaser does not construct.
