Common use of Treatment of Seniority, Benefits and Return to Position Clause in Contracts

Treatment of Seniority, Benefits and Return to Position. Unless expressly stated otherwise, when an Employee has been granted a leave of absence without pay the Employee’s seniority is retained but not accumulated. The Employee is not entitled to statutory holidays and does not accumulate vacation leave, sick leave or any other benefits measured by length of service. Upon completion of leave, the Employee shall be placed in their former position or, if that position no longer exists, a similar position. If such employment is not available, Article 33 shall apply.
