Common use of Trustee’s option Clause in Contracts

Trustee’s option. At any time before the Trustee has nominated an arbitrator to resolve any Dispute(s) pursuant to Clause 20.2 (Arbitration), the Trustee, at its sole option, may elect by notice in writing to the Bank that such Dispute(s) shall instead be heard by the courts of England, as more particularly described in Clause 20.4 (Jurisdiction). Following any such election, no arbitral tribunal shall have jurisdiction in respect of such Dispute(s).
