Common use of Truth-In-Negotiation Representation Clause in Contracts

Truth-In-Negotiation Representation. LICENSEE's compensation under this Agreement is based upon representations supplied to PACA by LICENSEE, and LICENSEE certifies that the information supplied, including without limitation in the negotiation of this Agreement, is accurate, complete, and current at the time of contracting. PACA shall be entitled to recover any damages it incurs to the extent such representation is untrue.
