Truth-in-Negotiations Certificate. If the Owner’s Project Manager’s fee is negotiated, by signing this Contract, the Owner’s Project Manager hereby certifies to the following:
Truth-in-Negotiations Certificate. For a lump sum, salary multiplier or cost-plus-a-fixed-fee professional service contract over the threshold amount provided in § 287.017, Florida Statutes, the respondent shall, if selected, execute a Truth in Negotiations Certificate stating that the wage rates and other factual unit costs supporting the compensation are accurate, complete and current at the time of contracting. If requested by the City, financial statements including balance sheet, profit and loss and statement of changes in financial position for the latest annual report for each participating firm shall be submitted together with the name of banks and other financial institutions with which the respondent conducts business.
Truth-in-Negotiations Certificate. Signature of this Agreement by the CONSULTANT shall also act as the execution of a truth-in-negotiation certificate certifying that the wage rates, over- head charges, and other costs used to determine the compensation provided for in this Agreement are accurate, complete and current as of the date of the Agreement and no higher than those charged the CONSULTANT’s most favored customer for the same or substantially similar service. The said rates and costs shall be adjusted to exclude any significant sums should the TPA determine that the rates and costs were increased due to inaccurate, incomplete or noncurrent wage rates or due to inaccurate representations of fees paid to outside consultants. TPA shall exercise its rights under this section within three (3) years following final payment.
Truth-in-Negotiations Certificate. The TAX COLLECTOR shall request DESIGN‐ BUILDER to execute a Truth‐in‐Negotiations Certificate ("Certificate"), in the form attached as Appendix 10. The Certificate shall state pursuant to Section 287.055 (5)(a), Florida Statutes, that the wage rates and other factual unit costs supporting the compensation to be paid to DESIGN‐ BUILDER are accurate, complete and current at the time this AGREEMENT is executed.
