Starting January 1, 2025, LIPA’s then effective non- discounted Wholesale TSC rate, as described in Table 1 (including footnote 1 above), shall apply. 3NYSEG’s RR, BU and unit Rate prior to adjustment pursuant to Attachment H, are subject to retroactive modification pursuant to the provisions of the Settlement Agreement approved by the Commission in its March 26, 2004 order issued in Docket No. EL04-56-000. For any Transmission Customer that “opts out” of the Settlement Agreement as described in paragraph 1.E thereof, the applicable NYSEG “RR” shall be $100,541,739; the “BU” shall be 13,741,901 MWh; and, the “Rate” prior to adjustment pursuant to Attachment H, shall be $7.4235 effective as of March 1, 2004.
