Common use of Unavailable Equipment or Drivers Clause in Contracts

Unavailable Equipment or Drivers. The District may temporarily subcontract if the necessary drivers and/or equipment are not available to promptly meet the unanticipated needs of the District. This exception is not intended to be used where the need is due to the District not adequately maintaining its equipment or hiring sufficient drivers to meet the reasonably expected needs of the District.
