Undesignated Timber Damaged Without Negligence. Undesignated timber meeting Utilization Xxxx- dards, damaged without negligence by Contractor and designated by Forest Service under C.1.3.1, shall be cut, re- moved, and paid for at Current Contract Rates and Required Deposits.

Undesignated Timber Damaged Without Negligence. Undesignated timber meeting Utilization Xxxx- dards, damaged without negligence by Purchaser and designated by Forest Service under B2.131, shall be cut, removed, and paid for at Current Contract Rates and Required Deposits. B3.45 Undesignated Timber Unnecessarily Damaged or Negligently or Willfully Cut. Undesignated timber meeting Utilization Standards and unnecessarily damaged or negligently or willfully cut by Purchaser, if included by Con- tracting Officer under B2.132, shall be cut, removed, and paid for at Current Contract Rates and Required Deposits that are in addition to liquidated damages under B3.46. If such timber is of a species or size not listed on Page 1 or is of a quality different from designated timber, Contract- ing Officer shall establish payment rates in accord with standard Forest Service methods.
Undesignated Timber Damaged Without Negligence. Undesignated timber meeting Utilization be reduced, if appraised rates declined during the delay or interruption, to become Current Contract Rates. Increases in rates will not be considered. Accordingly, Base Rates shall be adjusted to correspond to the redetermined rates if redetermined rates are less than the original Base Rates, subject to a new Base Rate limitation of the cost of essential reforestation or 25 cents per hundred cubic feet or equivalent, whichever is larger. However, existing Base Indices shall not be changed under this Subsection. Redetermined rates shall be considered established under B3.1 for timber Scaled subsequent to the delay or interruption.

  • Negligent or Willful Damage Un- designated timber meeting Utilization Standards and un- necessarily damaged or negligently or willfully cut by Pur- chaser, if included by Contracting Officer.

  • Property Damages The User’s guests are required to respect all University property. • Guests may not remodel, alter, tamper with or move furniture, electrical or mechanical fixtures, or other University property. • The User agrees to refrain from the use of adhesives, nails, or items that may damage the premises. The University will, to the best of its ability, try to document the names of guests when damages occur but cannot always obtain such information.

  • Liability for Damage Each party shall be liable to the other for all damage to the property of the other negligently, recklessly or intentionally caused by that party (or their agents, employees or invitees), except to the extent the loss is insured and subrogation is waived under the owner's policy.

  • Causes The contract may be terminated before the stated completion date by any of the following conditions.

  • Property Damage Lessee shall obtain and maintain insurance coverage on all of Lessee's personal property, Trade Fixtures, and Lessee Owned Alterations and Utility Installations. Such insurance shall be full replacement cost coverage with a deductible of not to exceed $1,000 per occurrence. The proceeds from any such insurance shall be used by Lessee for the replacement of personal property, Trade Fixtures and Lessee Owned Alterations and Utility Installations. Lessee shall provide Lessor with written evidence that such insurance is in force.
