Unfulfilled Obligation. If either party fails to fulfill an obligation under the agreement, the other party shall request rectification in writing. The cli- ent’s written request for rectification must be made within fourteen (14) calendar days from the time when the obligation should have been fulfilled. If the failed obligation is not remedied without unreasonable delay, and is in fact essential, the other party is entitled to im- mediately terminate the contract and request any damages re- lated in paragraph 13.
Unfulfilled Obligation. Notwithstanding the issue of the Maintenance certificate the Contractor and (subject to sub - clause (2) of this clause) the Employer shall remain liable for the fulfillment of any obligation incurred under the provisions of the Contract prior to the issue of the Maintenance Certificate which remains un-performed at the time such certificate is issuedand for the purpose of determining the nature and extent of any such obligation, the contract shall be deemed to remain in force between the parties hereto.
