Common use of Unplanned Outages Clause in Contracts

Unplanned Outages. Notwithstanding events of Force Majeure, the Seller shall use all reasonable endeavours to minimise the number and duration of any Outages not included on the Planned Outage Schedule ("Unplanned Outages") that occur during the Total Supply Period. The Seller shall, as soon as reasonably practicable following the occurrence of an Unplanned Outage during the Total Supply Period, notify the Buyer of such Unplanned Outage and remedy the Unplanned Outage. On notifying the Buyer of an Unplanned Outage, the Seller shall also inform the Buyer of its best estimate as to the likely duration of the Unplanned Outage, the reason for the Unplanned Outage and any reduction in the Facility's Capacity likely to follow the Unplanned Outage.
