Common use of USE AND FEES Clause in Contracts

USE AND FEES. 1. MCST will have exclusive use of the pool during the Preseason and Season dates and times identified below. MCST will have non-exclusive shared use of the pool during the Postseason dates and times identified below. All said MCST use times shall be only swim team purposes, activities and programs. The Preseason and Season schedule shall be set by mutual agreement of the Parties and MCST may not vary from the Preseason and Season schedule without formal written approval of the City. The City Manager is hereby delegated the authority to determine whether such approval shall be given or not, in the exercises of his/her sole and absolute discretion, and to authorize pro-ration of preseason fees (but not per swimmer fees), due to periods of facility closure.
