Use of Funding for Lobbying or Advocacy Purposes a. The STP shall ensure that neither the STP nor any of its Subcontractors or Transportation Providers use Medicaid funding to lobby, advocate, or encourage other parties to lobby or advocate legislators or other political leaders in violation of State and federal law. If the Commission determines that the STP, a Subcontractor, or a Transportation Provider has violated this requirement against lobbying or advocating, the Commission may sanction the STP. If this agreement contains federal funding in excess of $100,000, the STP must, upon Agreement execution, complete the Certificate Regarding Lobbying, Attachment 3. It should be signed by a duly authorized officer and submitted along with the executed contract. The Disclosure of Lobbying Activities form, Standard Form LLL, is provided as Attachment 4. All disclosure forms as required by the Certification Regarding Lobbying form must be completed and returned to the Commission no later than thirty (30) calendar days before the effective date of the Agreement. b. The STP shall ensure that all Subcontractors and Transportation Providers execute a Certificate Regarding Lobbying for agreements that contain federal funding in excess of $100,000. The Certificate should be an attachment to the agreements and should be completed should be signed by a duly authorized officer and submitted to the STP upon execution of the agreement. If a Disclosure of Lobbying Activities form, Standard Form LLL, is required, it may be obtained from the STP. All disclosure forms as required by the Certification Regarding Lobbying from must be completed and returned to the STP no later than thirty (30) calendar days before the effective date of the Agreement. c. All of the lobbying and advocating requirements set forth in this Agreement apply to the STP, Subcontractors, Transportation Providers, volunteers, employees, independent contractors, and all persons acting for, or on behalf of, the STP. The requirements set forth in this Section shall govern the development of all materials. Additionally, the STP is vicariously liable for any Violations of its Subcontractors, Transportation Providers, agents, employees, staff, and/or independent contractors.

If the COUNTY determines that RIDE RIGHT, a subcontractor, or a transportation provider has violated this requirement against lobbying or advocating, the COUNTY may sanction RIDE RIGHT. b. The Recipient shall ensure that all subcontractors and transportation providers execute a certificate regarding lobbying no less than thirty (30) calendar days before the effective date of the Agreement and maintain copies of said certificates in RIDE RIGHT’s files. c. All of the lobbying and advocating requirements set forth in this Agreement apply to staff, subcontractors, transportation providers, recipient volunteers, employees, independent contractors, and all persons acting for, or on behalf of, the recipient. The requirements set forth in this Section shall govern the development of all materials. Additionally, the recipient is vicariously liable for any violations of its subcontractors, transportation providers, agents, employees, staff, and/or independent contractors.

  • Your Liability for Unauthorized Transfers Immediately following your discovery of an unauthorized Payment Instruction, you shall communicate with customer care for the Service in the manner set forth in Section 6 of the General Terms above. If you tell us within two (2) Business Days after you discover your password or other means to access your account through which you access the Service has been lost or stolen, your liability is no more than $50.00 should someone access your account without your permission.   • Continuance of Agreement for Certain Purposes If any Party terminates this Agreement with respect to any Fund pursuant to Sections 6.1(b), 6.1(c), 6.1(d), 6.1(f), 6.1(g), 6.1(h) or 6.1(i) hereof, this Agreement shall nevertheless continue in effect as to any Shares of that Fund that are outstanding as of the date of such termination (the "Initial Termination Date"). This continuation shall extend to the earlier of the date as of which an Account owns no Shares of the affected Fund or a date (the "Final Termination Date") six (6) months following the Initial Termination Date, except that LIFE COMPANY may, by written notice shorten said six (6) month period in the case of a termination pursuant to Sections 6.1(d), 6.1(f), 6.1(g), 6.1(h) or 6.1(i).

  • Funding Disclaimers and Labeling A. Grantee shall not use System Agency’s name or refer to System Agency directly or indirectly in any media appearance, public service announcement, or disclosure relating to this Grant Agreement including any promotional material without first obtaining written consent from System Agency. The foregoing prohibition includes, without limitation, the placement of banners, pop-up ads, or other advertisements promoting Grantee’s or a third party’s products, services, workshops, trainings, or other commercial offerings on any website portal or internet-based service or software application hosted or managed by Grantee. This does not limit the Grantee’s responsibility to comply with obligations related to the Texas Public Information Act or Texas Open Meetings Act. B. In general, no publication (including websites, reports, projects, etc.) may convey System Agency’s recognition or endorsement of the Grantee’s project without prior written approval from System Agency. Publications funded in part or wholly by HHS grant funding must include a statement that “HHS and neither any of its components operate, control, are responsible for, or necessarily endorse, this publication (including, without limitation, its content, technical infrastructure, and policies, and any services or tools provided)” at HHS’s request.

  • Parties; Limitation of Relationship This Agreement shall inure solely to the benefit of, and shall be binding upon, the Underwriters, the Company and the controlling Persons, directors, officers, employees and agents referred to in Sections 7 and 8 hereof, and their respective successors and assigns, and no other Person shall have or be construed to have any legal or equitable right, remedy or claim under or in respect of or by virtue of this Agreement or any provision herein contained. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure. 3. The prospective participant also agrees by submitting its bid or proposal that the participant shall require that the language of this certification be included in all lower tier subcontracts, which exceed $100,000 and that all such recipients shall certify and disclose accordingly. This provision is applicable to all Federal-aid projects funded under the Appalachian Regional Development Act of 1965. 1. During the performance of this contract, the contractor undertaking to do work which is, or reasonably may be, done as on-site work, shall give preference to qualified persons who regularly reside in the labor area as designated by the DOL wherein the contract work is situated, or the subregion, or the Appalachian counties of the State wherein the contract work is situated, except: a. To the extent that qualified persons regularly residing in the area are not available. b. For the reasonable needs of the contractor to employ supervisory or specially experienced personnel necessary to assure an efficient execution of the contract work. c. For the obligation of the contractor to offer employment to present or former employees as the result of a lawful collective bargaining contract, provided that the number of nonresident persons employed under this subparagraph (1c) shall not exceed 20 percent of the total number of employees employed by the contractor on the contract work, except as provided in subparagraph (4) below. 2. The contractor shall place a job order with the State Employment Service indicating (a) the classifications of the laborers, mechanics and other employees required to perform the contract work, (b) the number of employees required in each classification, (c) the date on which the participant estimates such employees will be required, and (d) any other pertinent information required by the State Employment Service to complete the job order form. The job order may be placed with the State Employment Service in writing or by telephone. If during the course of the contract work, the information submitted by the contractor in the original job order is substantially modified, the participant shall promptly notify the State Employment Service. 3. The contractor shall give full consideration to all qualified job applicants referred to him by the State Employment Service. The contractor is not required to grant employment to any job applicants who, in his opinion, are not qualified to perform the classification of work required. 4. If, within one week following the placing of a job order by the contractor with the State Employment Service, the State Employment Service is unable to refer any qualified job applicants to the contractor, or less than the number requested, the State Employment Service will forward a certificate to the contractor indicating the unavailability of applicants. Such certificate shall be made a part of the contractor's permanent project records. Upon receipt of this certificate, the contractor may employ persons who do not normally reside in the labor area to fill positions covered by the certificate, notwithstanding the provisions of subparagraph (1c) above. 5. The provisions of 23 CFR 633.207(e) allow the contracting agency to provide a contractual preference for the use of mineral resource materials native to the Appalachian region. 6. The contractor shall include the provisions of Sections 1 through 4 of this Attachment A in every subcontract for work which is, or reasonably may be, done as on-site work.
