Use of Music Previously Recorded Under Another Federation Agreement. When music originally recorded under the AFM Sound Recording Labor Agreement, Basic Theatrical Motion Picture, TV Film Agreement, or any other Federation or Local Agreement is used or licensed for use in any product(s) covered by the scope of this Agreement, musicians shall be compensated per the applicable terms of this Agreement as follows:

Use of Music Previously Recorded Under Another Federation Agreement. When any music originally recorded under any AFM Agreement is used in a Video Game, the Employer shall pay to or on behalf of those Musicians who rendered services preparing or recording such music, one session payment per song under Schedule B, including doubles, excluding only Health and Welfare contributions. The effective date for determining Scale Wages is the release date of the Video Game. For the purposes of this section, when music is used that was previously recorded under the AFM Sound Recording Labor Agreement (SRLA), Musicians shall be compensated as specified above per Song/Track. For Underscore/Cues, Employer shall pay one session payment under Schedule B, excluding only Health and Welfare contributions, per 15 minutes of music. When applicable, Orchestrators, Copyists and other Music Preparation Musicians shall be compensated based on 125% of the Low Budget provisions of the current AFM Basic Theatrical Motion Picture Agreement, as per Schedule B under Music Preparation (Paragraph 18, Schedule B).

Use of Music Previously Recorded Under Another Federation Agreement. When music originally recorded under any AFM Agreement is used in this video game, provided such use is not prohibited by that original agreement, the Employer shall pay to or on behalf of those musicians who rendered services preparing or recording such music, all amounts (excluding only health and welfare contributions) that would be required if the recordings were originally made pursuant to this Video Game Agreement.

  • Certification Regarding Entire TIPS Agreement for Part 1 and Part 2 Contracts 5 This is a two part solicitation. Part 1 is solicited for TIPS sales that are not considered a "public work" construction project. Part 1 permits the sale of goods and non-construction/non-"public work" services such as maintenance and minor repairs. Part 2 Job Order Contract (JOC) is solicited for projects considered by your TIPS Member Customers to be a "public work" construction project. The determination of whether or not a TIPS sale amounts to a "public work" construction project requiring a Part 2 JOC contract is made by the TIPS Member Customer at the time of each TIPS sale. Thus, Vendors are encouraged to respond to both Parts 1 and 2 in case your TIPS Member Customers require that a sale be made under one Part or the other. However, responding to both Parts is not required. If Vendor responds and is awarded to both Parts, Vendor will have one contract for Part 1 and a separate contract for Part 2.

  • CERTIFICATION PROHIBITING DISCRIMINATION AGAINST FIREARM AND AMMUNITION INDUSTRIES (Texas law as of September 1, 2021) By submitting a proposal to this Solicitation, you certify that you agree, when it is applicable, to the following required by Texas law as of September 1, 2021: If (a) company is not a sole proprietorship; (b) company has at least ten (10) full-time employees; (c) this contract has a value of at least $100,000 that is paid wholly or partly from public funds; (d) the contract is not excepted under Tex. Gov’t Code § 2274.003 of SB 19 (87th leg.); and (e) governmental entity has determined that company is not a sole-source provider or governmental entity has not received any bids from a company that is able to provide this written verification, the following certification shall apply; otherwise, this certification is not required. Pursuant to Tex. Gov’t Code Ch. 2274 of SB 19 (87th session), the company hereby certifies and verifies that the company, or association, corporation, partnership, joint venture, limited partnership, limited liability partnership, or limited liability company, including a wholly owned subsidiary, majority-owned subsidiary parent company, or affiliate of these entities or associations, that exists to make a profit, does not have a practice, policy, guidance, or directive that discriminates against a firearm entity or firearm trade association and will not discriminate during the term of this contract against a firearm entity or firearm trade association.   • CALENDAR FOR SUCCESSOR MEMORANDUM OF UNDERSTANDING In the event Union or Management desires a successor MOU, said party shall serve upon the other between April 1, 2018 and April 30, 2018, its written proposals for such successor MOU. Meet and confer sessions shall begin no later than thirty (30) calendar days following submittal of the proposals.
