Common use of VARIATION AND WAIVER Clause in Contracts

VARIATION AND WAIVER. 7.1 No variation or waiver of any of the Transaction Documents other than this Agreement, shall be effective unless it is in writing and signed by each of the parties to the Transaction Documents concerned. No single or partial exercise of, or failure or delay in exercising, any right under any of the Transaction Documents shall constitute a waiver or preclude any other or further exercise of that or any other right.
