Common use of Verizon’s Provision of Collocation Clause in Contracts

Verizon’s Provision of Collocation. Verizon shall provide to dishNet, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNet’s interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet only to the extent required by Applicable Law and may decline to provide Collocation to dishNet to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 47

Verizon shall provide to dishNetIntrado Comm, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs Tariffs, and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNetIntrado Comm’s interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet Intrado Comm only to the extent required by Applicable Law and may decline to provide and/or cease providing Collocation to dishNet Intrado Comm to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet Intrado Comm to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet Hypercube to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.

Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet PacOptic to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.

Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet InteleTel to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.

Verizon shall provide to dishNetBandwidth, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNetBandwidth’s interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet Bandwidth only to the extent required by Applicable Law and may decline to provide Collocation to dishNet Bandwidth to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet Bandwidth to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.

Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet WCS to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 47

Verizon shall provide to dishNetMosaic, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNetMosaic’s interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet Mosaic only to the extent required by Applicable Law and may decline to provide Collocation to dishNet Mosaic to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet Mosaic to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 47

Verizon shall provide to dishNetGlobetel, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNetGlobetel’s interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet Globetel only to the extent required by Applicable Law and may decline to provide Collocation to dishNet Globetel to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet Globetel to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.

Verizon shall provide to dishNetiNetworks, in accordance with this Agreement, Verizon’s applicable federal and state Tariffs and the requirements of Applicable Law, Collocation for the purpose of facilitating dishNet’s iNetworks’ interconnection with Verizon under 47 U.S.C. § 251(c)(2) or access to Unbundled Network Elements of Verizon; provided, that notwithstanding any other provision of this Agreement or a Tariff, Verizon shall be obligated to provide Collocation to dishNet iNetworks only to the extent required by Applicable Law and may decline to provide Collocation to dishNet iNetworks to the extent that provision of Collocation is not required by Applicable Law. Notwithstanding any other provision of this Agreement or a Tariff, nothing in this Agreement or a Tariff shall be deemed to require Verizon to provide (and, for the avoidance of any doubt, Verizon may decline to provide and/or cease providing) Collocation that, if provided by Verizon, would be used by dishNet iNetworks to obtain unbundled access to any network element: (a) that Verizon is not required to unbundle under 4747 U.S.C. § 251(c)(3) or (b) that Verizon is not required to unbundle under 47 C.F.R. Part 51.
