ViaSat Equipment. If you purchased your Equipment, the terms of sale applicable to the ViaSat Equipment are governed by your purchase agreement or other documents evidencing such sale and, if applicable, ViaSat’s limited warranty (available at xxx.xxxxxxxxxxxxxxxxx.xxx/xxxxx) and service plan, if any. In addition, ViaSat Equipment contains software and/or other intellectual property subject to a license agreement(s) (“License Agreement”) provided with the ViaSat Equipment. Any breach of the License Agreement constitutes a breach of this Agreement.

  • Equipment The Fund shall obtain and maintain at its own cost and expense all equipment and services, including but not limited to communications services, necessary for it to utilize the Software and obtain access to the System, and Custodian shall not be responsible for the reliability or availability of any such equipment or services.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.
