Waiver Procedures. The observance by the Company of any provision of this Article V may be waived (either generally or in a particular instance and either retroactively or prospectively) with the written consent of the Holders of a majority of the Registrable Securities, and any waiver effected in accordance with this paragraph shall be binding upon each Holder of Registrable Securities.

A State motor vehicle department may establish and carry out procedures under which the department or its agents, upon receiving a request for personal information that does not fall within one of the exceptions in subsection (b), may mail a copy of the request to the individual about whom the information was requested, informing such individual of the request, together with a statement to the effect that the information will not be released unless the individual waives such individual's right to privacy under this section.

Waiver Procedures. A waiver of health insurance form is available from the payroll office. This form shall be distributed to all employees by June 1 and returned to the Payroll Office no later than June 15. Election for the waiver of health insurance shall be made on an annual basis, subject to the 5% limitation set forth above, and such waiver shall be for only one (1) year. Election is voluntary and is renewable on subsequent application. Employees not re-electing the waiver shall be automatically re-enrolled in the district’s health insurance plan upon completion of the necessary paperwork without penalty or restriction including but not limited to pre-existing conditions for themselves and eligible dependents. All employees shall have the option of considering the waiver each year of this agreement, subject to the terms of this provision.

Waiver Procedures.
A. A faculty member may waive any provision of this Agreement with written consent of the Association Negotiation Committee.
Waiver Procedures. Each building wishing to request a Waiver of Contract Provisions shall do so through consensus submission to the Committee by the BLT.
A. Any deviation from the Negotiated Agreement must be approved by the Superintendent and Association President.
B. All deviations from the Negotiated Agreement shall specify the applicable length of time, and may be extended by agreement.
1. If a BLT recommendation(s) requires a deviation from the Negotiated Agreement, the decision process shall include an opportunity for all certified staff within the building to share their opinions. A building decision shall not be implemented in any school year without at least a two-thirds (2/3) majority vote of the bargaining unit members present and voting and approval from the Superintendent and Association President. Voting on a waiver may not exceed two (2) days and a re-vote may not be held until the following year.
2. Any variance of the Negotiation Agreement contract may be identified by the BLT.
a. The request for a waiver must be signed by the committee facilitator and building principal.
b. It must describe the decision-making process and include in as much detail as possible the provision wished to be waived, the nature of the waiver, reason for the waiver, and how bargaining unit members may be affected by the waiver.
c. The waiver must be mutual and formally agreed to by the President of the Association and Superintendent.
3. The following articles (of the negotiated agreement) are not subject to consideration for waiver:
a. Article 5 Association Rights and Privileges
b. Article 7 Assignment and Transfer
c. Article 8 Protection of Teachers
d. Article 15 Multiple School Assignment e. Article 21 Leaves f. Article 23 Political Activity g. Article 28 Salary Payments
Waiver Procedures. A school may under the Adna School District Long Range Improvement Plan or under School Board approved projects submitted through the Learning Improvement Teams, request that the District and Association waive requirements of the Collective Bargaining Agreement, and Board Policies if there is a conflict between the terms of the contract or policies and the proposed projects. Such waiver is subject to the following:
A. The request must be for the purpose of program improvement/student learning.
B. C. The request must include:
1. Reference to the specific provision of the Agreement requested to be waived;
2. Rationale attesting to the need for the waiver;
3. Timelines (if applicable);
4. Costs (if applicable);
5. Affect of waiver on other areas of the Agreement.
D. The waiver request must be submitted to the Superintendent or Designee and the Association concurrently, and will be granted only if both the District and Association agree. Board policy waivers should be submitted to the Board for consideration using the normal process for submitting business items to the Board.
Waiver Procedures. The student wishing to graduate with less than seven semesters must secure a recommendation from his/her guidance counselor and principal. ● The waiver may be granted only under the following conditions: ○ The waiver is for the purpose of enrolling in an accredited post-secondary educational institution, and the student has been accepted for enrollment. ■ The student and parent will review the FAFSA requirements and file the application no later than April 15th of their junior year. ○ Or, the waiver is for the purpose of furthering the student’s education through military enlistment and the student has an enlistment contract that contains an educational component. ○ The counselor must communicate with the student’s parents, explain the procedure to them, and receive approval during the Spring semester of their 10th grade year. A Request for Early High School Graduation Form must be completed, along with a counselor checklist. ○ Prior to the effective date of the waiver, those students shall be permitted to participate in any curricular activity and shall enjoy the same rights and privileges as a regular student at East Central High School. ○ After the effective date of the waiver, these students shall NOT be permitted to continue as regular members in school sponsored activities which require meetings on school time during the regular school day. ○ After the effective date of the waiver, these students shall NOT be permitted: ■ To attend school events as an ECHS student ■ To attend dances (i.e. Prom) ■ To participate in extracurricular activities ■ To participate in any student related activities, awards ceremonies, etc. ○ Students completing work for graduation with less than seven semesters are encouraged to graduate from East Central High School at the same time and in the regular manner as seven/eight semester graduates. ○ Six-semester graduates will have the option of participating in any honorary action afforded during the commencement ceremony not including Student Body President or Senior Class President. ○ In the event the request for xxxxxx is denied by the high school principal, such denial may be appealed to the school superintendent. Failure to meet the requirements of this waiver would effectively prevent the student from graduating high school.
