Common use of Warranty Exclusion Clause in Contracts

Warranty Exclusion. TRT shall not be liable for any damage whatsoever caused to the Goods and/or Capital Goods including under any warranty, in the event that such Goods and/or Capital Goods are not installed or maintained by qualified tradesmen and/or if such Goods and/or Capital Goods are in any way adapted to a use for which they are not specifically intended and/or fitted with or repaired by components not recommended or approved by TRT. TRT shall not liable whatsoever for any damage caused by misuse, neglect, improper operation, improper maintenance installation by a third party, modification or adjustment or fair wear and tear.
