Warranty Exclusion. NEITHER PARTY PROVIDES ANY WARRANTY WHATSOEVER TO THE OTHER PARTY WITH RESPECT TO THE DEVELOPED TECHNOLOGY. Nothing contained in this Agreement shall be construed as a warranty or representation by either party that any manufacture, use, sale, lease or other disposition of the Developed Technology will be free from infringement of any patent or other proprietary right of any third party.
