Kincaid makxx xx xarranties or representations whatsoever, whether express or implied, with respect to Kincaid Proxxxxx xxcept such warranty as may from time to time be provided with respect to the Kincaid Proxxxx xx which the warranty in question is applicable. In connection with each sale of Kincaid Proxxxxx, Retailer shall pass any warranty of Kincaid on xx xxx Retailer's customer. Retailer agrees to make no other promise, representation or warranty of any kind or character whatsoever, express or implied, with respect to a Kincaid Proxxxx xxcept the Kincaid warxxxxx xpplicable thereto, if any. Kincaid shaxx xxxx no liability or obligation whatsoever to Retailer or any other person other than the applicable Kincaid warxxxxx, if any, and Retailer shall defend, indemnify and hold Kincaid harxxxxx xrom any and all claims, demands, proceedings or actions of any kind or character whatsoever arising in any manner whatsoever from any additional promise, representation or warranty made by Retailer. UNDER NO CIRCUMSTANCES SHALL KINCAID BE XXXXXX IN ANY MANNER WHATSOEVER FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES SUSTAINED BY DEALER DUE TO ANY DEFECT IN, OR FAILURE OF QUALITY OF, ANY KINCAID PROXXXX. Retailer further acknowledges and agrees that Kincaid's lxxxxxxxx under any applicable warranty is conditioned upon Kincaid beixx xxxxided with such information as it may request in order to determine to its satisfaction that a breach of warranty has occurred, which may include, among other things, return of the allegedly defective item to Kincaid for xxx xxspection. THE WARRANTIES DESCRIBED HEREIN SHALL BE THE ONLY WARRANTIES MADE BY KINCAID WITX XXXXXCT TO ITS PRODUCTS AND SHALL BE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING ANY AND ALL OTHER WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHERWISE IMPLIED BY LAW. KINCAID EXPXXXXXX RESERVES THE RIGHT TO CHANGE, AMEND OR ABOLISH ANY WARRANTIES IT MAY FROM TIME TO TIME MAKE WITH RESPECT TO ITS PRODUCTS BY WRITTEN NOTIFICATION TO DEALER.
