Common use of Warranty Policy Clause in Contracts

Warranty Policy. SAMSUNG warrants to the original end user customer or purchaser of this Product ("You”) that the Product is free from material defects and workmanship, subject to the conditions stated herein. In the event SAMSUNG determines, in its sole discretion, that the Product suffers from material defects in manufacture and does not substantially conform to the published specifications under normal use, for as long as You own the Product, and subject to the conditions and exceptions stated in this Agreement, SAMSUNG will, at its option, either: (1) repair or replace the Product with new or refurbished Product of equal or greater capacity and functionality; or (2) issue a credit, less any rebates, in accordance with the credit schedule provided in Section E of this Agreement. In the case of replacements, SAMSUNG may replace Your Product with one that was previously used, repaired and tested to meet SAMSUNG specifications. This warranty is provided only to You and is not transferable. Proof of purchase may be required. THIS AGREEMENT CONTAINS SAMSUNG’S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY FOR BREACH OF THIS AGREEMENT. SAMSUNG DISCLAIMS ALL OTHER EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL SAMSUNG, ITS SUPPLIERS OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, ANY FINANCIAL LOSS OR ANY LOST DATA OR FILES, EVEN IF SAMSUNG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. IN NO EVENT WILL SAMSUNG’S LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT. THESE LIMITATIONS AND EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Warranty Policy. SAMSUNG R3 Robotics LLC (R3) warrants to the original end user customer or purchaser of this Product that R3's products ("Youthe “Products”) that the Product is are free from defects in material defects and workmanshipworkmanship for a period of one (1) year from the date of original purchase, subject unless a different period is otherwise expressly stated below (the “Warranty Period”). R3's obligation under this warranty is expressly limited to the conditions stated herein. In the event SAMSUNG determinessupplying replacement parts, repairing, or replacing, at its sole option, any product which R3, in its sole judgment and discretion, that determines contained a defect in materials or workmanship at the Product suffers time of shipment from material defects in manufacture and HTA. This warranty does not substantially conform to the published specifications under normal use, for as long as You own the Product, include on-site service or removal and subject to the conditions and exceptions stated in this Agreement, SAMSUNG will, at its option, either: (1) repair or replace the Product with new or refurbished Product of equal or greater capacity and functionality; or (2) issue a credit, less any rebates, in accordance with the credit schedule provided in Section E of this Agreement. THIS AGREEMENT CONTAINS SAMSUNG’S ENTIRE LIABILITY LIMITED WARRANTY IS EXCLUSIVE, IS R3's ONLY WARRANTY, AND YOUR EXCLUSIVE REMEDY FOR BREACH IS EXPRESSLY IN LIEU OF THIS AGREEMENTANY OTHER EXPRESS OR IMPLIED WARRANTIES. SAMSUNG R3 HEREBY DISCLAIMS ANY AND ALL OTHER EXPRESS WARRANTIES AND WARRANTIES THAT MAY BE IMPLIED WARRANTIESBY LAW, INCLUDING BUT NOT LIMITED TO ANY INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, AND OF FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENTOR SPECIFIED USE. IN NO EVENT SHALL SAMSUNG, ITS SUPPLIERS OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, ANY FINANCIAL LOSS OR ANY LOST DATA OR FILES, EVEN IF SAMSUNG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. THESE LIMITATIONS AND EXCLUSIONS APPLY TO THE FULLEST MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW., R3, ITS SUBSIDIARIES, AND PARENTS SHALL NOT BE RESPONSIBLE FOR AND HEREBY DISCLAIMS ALL LIABILITY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES INCURRED BY YOU OR ANY OTHER PERSON OR ENTITY HOWEVER CAUSED, WHETHER BY THE NEGLIGENCE OF R3 OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, ANY LIABILITY (i) FOR LOST REVENUES, LOST PROFITS, LOSS OF USE, THE COST OF DATA RECOVERY FROM HARD DISK DRIVES, THE VALUE OF DATA THAT CANNOT BE RECOVERED FROM HARD DISK DRIVES, OR ANY OTHER COMMERCIAL LOSSES OF ANY TYPE; (ii) FOR INJURY TO OR DEATH OF ANY PERSONS IN CONNECTION WITH THE PRODUCTS; AND (iii) FOR DAMAGES TO PROPERTY OF ANY TYPE IN CONNECTION WITH THE PRODUCTS; AND
