Water Xxxxx and Postal Service Parcel. 17 5.8.1 General – Water Xxxxx 18 Water xxxxx held for public use are deemed Utilities under the Contract 19 Documents and are subject to the provisions therefor. Water xxxxx held for private use 20 are deemed real property subject to the Uniform Act and real property acquisition 21 provisions of the Contract Documents, and, except as provided in Section 5.8.2, ADOT 22 has the power to condemn such water xxxxx that may need closure or abandonment in 23 order to build the Project. 24 5.8.2 GRIC Well ParcelsProperties 25 5.8.2.1 This Section 5.8.2 provides special terms that supersede 26 any contrary provisions in this Article 5 or in Section DR 470 of the Technical 27 Provisions. 28 5.8.2.2 Developer recognizes and acknowledges ADOT has no 29 30 31 32 33 34 35 36 power to condemn land parcels within which water wellsproperty rights and interests owned by or on behalf of the GRIC for or in connection with water xxxxx, including fee title and air rights respecting land parcels on which such xxxxx are located (“, and easements for pipes and ditches serving such water xxxxx or for access (collectively the “GRIC well parcelsproperties”). Accordingly, but subject to Section 5.8.2.3, Developer’s design shall avoid (including avoidance of airspace above) and and preserve the GRIC well properties, GRIC’s legal access to GRIC well parcelsproperties, and the water xxxxx, pipes and ditches located therein.
