When Transmission Occurs. For the purpose of this Agreement, transmission of business will occur if the employer’s business, or part of its business, is transferred to another employer (“the new employer”) whether by way of sale of the business or otherwise, and all or some of the employer’s employees are offered employment with the new employer on substantially similar terms as their employment with the employer.
