Common use of Where, on cessation Clause in Contracts

Where, on cessation. of employment, the employer makes a payment in lieu of notice; or a payment in respect of accrued recreation or long service leave entitlements (instead of transferring leave credits to another employer party to this Enterprise Agreement in the event the employee immediately becomes employed by that employer party), the payment thereof shall be based on the rate of pay that would have been payable had the employee not entered into a SSA.

Where, on cessation. of employment, the employer makes a payment in lieu of notice; or a payment in respect of accrued recreation or long service leave entitlements (instead of transferring leave credits to another employer party to this Enterprise Agreement WPEA in the event the employee immediately becomes employed by that employer party), the payment thereof shall be based on the rate of pay salary that would have been payable had the employee not entered into a SSA.
