Common use of WITHHOLDING OF PROFESSIONAL SERVICES Clause in Contracts

WITHHOLDING OF PROFESSIONAL SERVICES. 10.1: It is recognized that the needs for care and proper treatment of patients are of paramount importance and that there should be no interference with such care and treatment. 10.2: Adequate procedures provide for the equitable settlement of grievances arising under this Agreement. The Association, and the members of the bargaining unit under this Agreement will not engage in or encourage any strike, sit-down, stay-in, slow-down, or other similar action which would interfere with the treatment and welfare of the patients or the services of the Department. 10.3: The Employer shall have the right to discipline or discharge any employee participating in such interferences and the Association agrees not to oppose such action. It is understood, however, that the Association shall have recourse to the Grievance Procedure as to matters of fact in the alleged actions of such employee. 10.4: The Employer will not lock out any employee during the term of this Agreement.
