Common use of Withholding Payment to Contractor or Suspension of Work Clause in Contracts

Withholding Payment to Contractor or Suspension of Work. All work which has been rejected or condemned shall be remedied or, if deemed necessary, shall be removed or replaced in a manner acceptable by the OWNER, by the CONTRACTOR, at his own expense. In addition to the other remedies provided herein should the CONTRACTOR fail to remove rejected materials or fail or refuse to remedy or replace defective work, the OWNER may withhold a reasonable amount of the payment which is due or which will become due, such amount to reflect the projected costs to remove rejected materials and/or remedy and replace defective work or he may suspend the affected work until such orders are complied with. Such withholding of payments or suspension of Work shall not be grounds for termination of this Contract by the CONTRACTOR.
