Common use of Without prejudice to Section 12 Clause in Contracts

Without prejudice to Section 12. 2.1, the Province may at any time by a specific notice require a revision to the Project Schedule to accelerate the performance of the Works or any component thereof, provided that if any such revision will result in an increase in the Concessionaire’s costs of completing the Works then such revision will be deemed to be a Province Change and the provisions of Part 2 of Schedule 13 [Province Changes] will apply accordingly.

Without prejudice to Section 12. 2.1, the Province may at any time by a specific notice require a revision to the Project Schedule to accelerate the performance of the design, construction, completion, commissioning and testing of the Works or the design and completion of the Decommissioning or both or any component thereofthereof (if such acceleration is reasonably possible), provided that if any such revision will result in an increase in the Concessionaire’s costs of completing the Works and the Decommissioning, as applicable, then such revision will be deemed to be a Province Change and the provisions of Part 2 of Schedule 13 [Province Changes] will apply accordingly.
