Without prejudice to Section. 16.3.1, the Concessionaire shall at all times ensure that the operations are performed by appropriately qualified and trained personnel and in accordance with: (i) the terms of this Agreement; (ii) Applicable Law and other legal requirements; (iii) Good Industry Practice; and (iv) the Operations & Maintenance Manual.
