Works in Dispute. Notwithstanding anything to the contrary herein, Google may withhold or delay release of any works not clearly in the public domain from the Escrow Deposit if Google’s Digitization, use or release of such work is the subject of a dispute between Google and a third party. In such event, Google must inform the CIC Administrative Offices or the Source CIC University, in writing, of the specific work(s) being withheld and the details of the dispute. If such portions of the University Digital Copy have previously been released to any CIC University under this Agreement, then that CIC University agrees to delete or destroy any such portions of the University Digital Copy in its possession or under its control.
