Xxxx Payment. The Xxxx Payment Service allows you to schedule xxxx payment through Bridge City Bank Online Banking Service. This Service is available pursuant to a license Agreement by and between Bridge City Bank and CheckFree. Bridge City Bank reserves the right to terminate your use of Xxxx Payment at any time. In the enrollment process, you must designate which checking account will be used as your Payment Account from which all xxxx payments will be made. By providing the names and account information of those Payees to whom you wish to direct payment, you authorize Bridge City Bank to follow the payment instructions that it receives from you. When we receive a payment instruction, you authorize us to debit your account and remit funds on your behalf so that the funds arrive as close to the payment date designated by you as reasonably possible. Bridge City Bank shall not be obligated to make any such payment unless your account has sufficient funds to pay the xxxx. Each Scheduled Payment Date selected by you must be entered no less than five (5) business days before the actual due date, not the late date and/or a date in the grace period. Your Payment Account will be debited for each xxxx payment on the Scheduled Payment Date. Payment instructions entered after 11:59 PM Eastern Time (10:59 PM Central) or a non-Business Day will be considered entered on the next Business Day. If you properly follow the procedures described herein, and we fail to send a payment according to your payment instructions received, we will bear responsibility for late charges up to $50.00 maximum. In any event, including, but not limited to, choosing a scheduled payment date no less than five (5) Business Days before the actual due date, the risk of incurring and the responsibility for paying any and all late charges or penalties shall be borne by you. We will not be liable if any third party through which any xxxx payment is made fail to properly transmit the payment to the intended payee. Bridge City Bank will exercise ordinary care to make your payments properly. If we do not complete a transfer to or from you account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, we shall incur no liability if we are unable to complete any payments initiated by you because of the existence of any one or more of the following circumstances: If through no fault of ours, your payment account does not have sufficient funds to complete the transaction or the transaction would exceed the limit of your overdraft privilege; If a legal order prohibits withdrawals from your payment account; If the payment account is closed or frozen; If you have been negligent with or given your PIN to another person(s); Your failure to “sign off or log off” to end your Bridge City State Bank Online session; The xxxx payment processing center or the electronic funds transfer system is not working properly and you knew or were advised by Bridge City Bank of the malfunction before you execute the transaction; The payee mishandles or delays a payment sent by us; You have not provided Bridge City Bank with the correct name, phone number, or account information for the Payee; If you have not properly followed the instructions for using Bridge City State Bank Online Banking instructions for xxxx payment; If there are circumstances beyond Bridge City Bank control (such as, but not limited to, fire, flood, loss of electricity or failure of telecommunications equipment or lines, or interference from an outside force) prevent the proper execution of the transaction and the Service has taken reasonable precautions to avoid those circumstances. There may be other exceptions stated in our agreement(s) with you. Provided none of the foregoing eleven (11) exceptions are applicable, if we cause an incorrect amount of funds to be removed from your Payment Account or cause funds from you Payment Account to be directed to a Payee which does not comply with your Payment Instructions, we shall be responsible for returning the improperly transferred funds to you Payment Account and for directing to the proper Payee any previously misdirected transactions. Xxxx Payment. The You may use the Xxxx Payment Service allows to direct Fifth Third to make payments from your account to payees in the United States that you choose. Fifth Third may refuse or cancel any payee or any payment at any time for any reason. It is your responsibility to manage your Payee List and maintain accurate Payee information. Occasionally a Payee may choose not to participate in the Xxxx Payment service, or may require additional information before accepting payments. Fifth Third Bank will work with these Payees to encourage them to accept an electronic or check payment from the bank. XXXX PAYMENTS scheduled to be processed on a particular date and initiated prior to the XXXX PAYMENT cut-off time for that day will be processed on that Business Day. XXXX PAYMENTS submitted after the XXXX PAYMENT cut-off time on a particular day will be processed on the next Business Day or Partial Business Day. C. You have the ability to request that a payee payment be reoccurring and automatically generated on a desired schedule and for a desired period of time allowed by SYSTEM. Recurring payments are automatically scheduled by the SYSTEM. A XXXX PAYMENT processing date for the next occurrence of the XXXX PAYMENT is automatically calculated based on your selected frequency for that XXXX PAYMENT. If the calculated XXXX PAYMENT processing date is a non- Business Day, then the XXXX PAYMENT processing date will be adjusted based on your selection for the XXXX PAYMENT. If the XXXX PAYMENT service "Pay Before" option is selected, the XXXX PAYMENT processing date will be adjusted to the first Business Day prior to the calculated XXXX PAYMENT processing date. If the XXXX PAYMENT service "Pay After" option is selected, the XXXX PAYMENT processing date will be adjusted to the first Business Day after the calculated Xxxx PAYMENT processing date. If your frequency settings for a XXXX PAYMENT specify the 29th, 30th or 31st as a particular day of the month for the XXXX PAYMENT processing date and that day does not exist in the month of the calculated Xxxx Payment processing date, then the last calendar day of that month will be used as the calculated XXXX PAYMENT processing date. D. The XXXX PAYMENT service will calculate an "Estimated Arrival Time" for a XXXX PAYMENT. This is only an estimate. BANK makes no warranties on the accuracy of this date and it should not be used for the purpose of scheduling XXXX PAYMENTS. E. You agree to pay any fees associated with an add-on additional service to XXXX PAYMENT such as processing a "Rush Payment" or sending an accompanying card. These fees are listed on the XXXX PAYMENT site and may be changed from time to time by the BANK, in its sole discretion. F. A XXXX PAYMENT can be changed or cancelled any time prior to the cut-off time on the scheduled processing date. G. In using the XXXX PAYMENT service, you recognize that: i. You are solely responsible for controlling the safekeeping of and access to your Personal Identification Number (PIN); ii. If you want to terminate another person's authority to use the XXXX PAYMENT service, you must notify the BANK and arrange to change your PIN; iii. You will be responsible for any XXXX PAYMENT request you make that contains an error or is a duplicate of another XXXX Payment; iv. The BANK is not responsible for a XXXX PAYMENT that is not made if you do not properly follow the instructions for making a XXXX PAYMENT; v. The BANK is not liable for your losses or damages. However, we shall incur no liability if we are unable to complete any payments initiated by you because of the existence of any one or more of the following circumstances: If through no fault of ours, your payment account does not have sufficient funds to complete the transaction or the transaction would exceed the limit of your overdraft privilege; If a legal order prohibits withdrawals from your payment account; If the payment account is closed or frozen; If you have been negligent with or given your PIN to another person(s); Your failure to “sign off or log off” make a XXXX PAYMENT if you fail to end your Bridge City State Bank Online session; The xxxx payment processing center or promptly notify the electronic funds transfer system is not working properly and BANK after you knew or were advised by Bridge City Bank of the malfunction before you execute the transaction; The payee mishandles or delays a payment sent by us; You have not provided Bridge City Bank with the correct name, phone number, or account information for the Payee; If learn that you have not properly followed the instructions received credit from a "payee" for using Bridge City State Bank Online Banking instructions a XXXX PAYMENT; and vi. The BANK is not responsible for xxxx payment; If there are circumstances beyond Bridge City Bank control (your acts or omissions or those of any other person including, with limitation, any transmission or communications facility and no such as, but not limited to, fire, flood, loss of electricity or failure of telecommunications equipment or lines, or interference from an outside force) prevent the proper execution of the transaction and the Service has taken reasonable precautions to avoid those circumstances. Provided none of the foregoing eleven (11) exceptions are applicable, if we cause an incorrect amount of funds deemed to be removed from your Payment Account or cause funds from you Payment Account to be directed to a Payee which does not comply with your Payment Instructions, we shall be responsible for returning the improperly transferred funds to you Payment Account and for directing to the proper Payee any previously misdirected transactions.
