Xxxxx’s Acceptance Sample Clauses

Xxxxx’s Acceptance. Xxxxx represents and acknowledges that it has entered into the Agreement on the basis of its own examination, personal knowledge, and opinion of the value of the business. Buyer has not relied on any representations made by Seller other than those specified in this Agreement. Buyer further acknowledges that Seller has made no agreement or promise to repair or improve any equipment, rolling stock or other personal property being sold to Buyer under this Agreement, and that Buyer takes all such property in the condition existing of the date of this Agreement, except as otherwise provided in this Agreement.

Xxxxx’s Acceptance. Xxxxx agrees to have an agent on the premises at the agreed upon time to accept goods, deliveries, installation, and completed work. All goods and services shall be considered accepted after Xxxxx or his agent has signed an acknowledgement document(s). All claims or exceptions must be made in writing the date the work is substantially complete. Notwithstanding the foregoing, if Buyer or Xxxxx’s agent is unavailable or unwilling to sign acknowledgment document(s), Buyer shall be deemed to have accepted the goods and services “as is” or as otherwise noted by Seller on the acknowledgement document.
Xxxxx’s Acceptance. Buyer shall be deemed to have made an unqualified acceptance of these Terms and Conditions and it shall become the agreement between the parties on the earliest of the following to occur: (i) Seller’s receipt of Buyer’s purchase order number or Buyer’s signing or acknowledgment of Seller’s Invoice or these Terms and Conditions; (ii) Buyer’s payment of any amounts due to Seller; (iii) Buyer’s delivery to Seller of any material to be furnished by Xxxxx; (iv) Buyer’s receipt of the Products; or (v) any other event constituting acceptance under applicable law.
Xxxxx’s Acceptance. Buyer shall be deemed to have made an unqualified acceptance of these Terms and Conditions and it shall become the agreement between the parties on the earliest of the following to occur: (i) Seller's receipt of Buyer's purchase order number or a signed copy of the Printing Services Agreement or Buyer's acknowledgment of Seller's Quotation, Acknowledgment, Invoice or these Terms and Conditions;

  • CONTRACT ACCEPTANCE By acceptance of this order, Xxxxxx agrees that the scope of the work required is understood by Xxxxxx; that there are no informal commitments by Buyer that in any way affect the work under this order; that there are no open or unresolved issues related to this order except as explicitly stated herein; and that Xxxxxx therefore understands and agrees that this order states the complete agreement of the parties. COST ACCOUNTING STANDARDS (CAS) CAS requirements do not apply if the order does not exceed $650,000 or if the Seller claims an exemption per the Proposal Representation and Certification, or if certified cost or pricing data was not provided.
