Common use of Xxxxxx's Compensation Insurance Clause in Contracts

Xxxxxx's Compensation Insurance. During the term of this Contract, CONTRACTOR shall provide workers’ compensation insurance for all of CONTARCTOR’S employees engaged in work under this Contract on or at the site of the Project and in case any of CONTRACTOR’S work is sublet, CONTRACTOR shall require the subcontractor to provide workers’ compensation insurance for all of subcontractor’s employees. Any class of employee or employees not covered by a subcontractor’s insurance shall be covered by the CONTRACTOR’S insurance. In case any class of employees engaged in work under this Contract on or at the site of the Project is not protected under the Workers’ Compensation laws, CONTRACTOR shall provide or cause a subcontractor to provide adequate insurance coverage for the protection of those employees not otherwise protected. CONTRACTOR shall file with the DISTRICT a certificate of workers’ compensation coverage pursuant to the Information to Bidders, Instruction for Insurance article, and in compliance with California Labor Code Section 3700. If CONTRACTOR fails to maintain such insurance, DISTRICT may take out compensation insurance which DISTRICT might be liable to pay under the provisions of the Act by reason of an employee of the CONTRACTOR being injured or killed, and deduct and retain the amount of the premium for such insurance from any sums due CONTRACTOR.
