Xxxxxxx Approval. If Xxxxxx fails to grant or withhold its consent or approval in writing (i) within a period of ten (10) Business Days after it has received a request for consent or approval under this Agreement and (ii) within an additional period of five (5) Business Days after it has received a second request for consent and which second notice shall advise Xxxxxx (in 14-point type or larger) that if Xxxxxx fails to respond to Borrower’s second request for consent within such five (5) Business Day period Xxxxxx shall be deemed to have approved or consented to the matter in question, then Xxxxxx shall be deemed to have approved or consented to such matter.
