Xxxxxxx’s failure to respond. Grantor may not proceed with any action for which Xxxxxxx seeks approval from Grantee without Xxxxxxx’s express written consent. Xxxxxxx’s failure to respond with the time period specified in Paragraph C above, therefore, shall be deemed Xxxxxxx’s constructive denial of approval.

Xxxxxxx’s failure to respond. If Grantee fails to respond to Xxxxxxx's request for approval within the response time set forth in paragraph C above, the proposed enterprise, use, or activity shall automatically be deemed consistent with the purposes of this Easement, Grantee having no further right to object to the enterprise, use, or activity identified by such notice. Xxxxxxx’s failure to respond to any individual request for approval shall not be deemed to be a waiver of any other duty and obligation of Grantor to seek prior approval for other specific activities for which Xxxxxxx’s approval is necessary.
Xxxxxxx’s failure to respond. In addition to the other rights granted in this Declaration, including the right of entry, Declarant may bring a legal action if Grantee fails to cure the violation within thirty (30) days after receipt of notice thereof from Declarant; fails to begin curing such violation within the thirty (30) day period under circumstances where the violation cannot reasonably be cured within the thirty (30) day period; or fails to continue diligently to cure such violation until finally cured.

  • Failure to Remedy If the Funder has provided the HSP with an opportunity to remedy the breach, and: the HSP does not remedy the breach within the time period specified in the Notice; it becomes apparent to the Funder that the HSP cannot completely remedy the breach within the time specified in the Notice or such further period of time as the Funder considers reasonable; or the HSP is not proceeding to remedy the breach in a way that is satisfactory to the Funder, then the Funder may immediately terminate this Agreement by giving Notice of termination to the HSP.
